Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kitchenry mobile and web applications (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1. Your Account

You must be at least 13 years old (16 in the EU) to create an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at support@kitchenry.app if you believe your account has been compromised.

2. Your Content

You retain ownership of all recipes, notes, images, and other content you create or upload ("Your Content"). By using the Service, you grant Kitchenry a limited, non-exclusive, worldwide, royalty-free licence to store, reproduce, and transmit Your Content solely to provide and improve the Service. We do not claim ownership of Your Content and will not use it for any other purpose.

When another user accepts a recipe you share, the Service creates an independent copy in that recipient's library. They may edit that copy, and it no longer stays linked to your original recipe.

To the extent you have rights to grant it, the licence above, as it applies to a copy of Your Content already received by another user through sharing, survives removal of Your Content, deletion of your account, or termination of these Terms solely so that recipient can continue to access, store, and use the copy already in their library. Removing your original — including in response to a copyright takedown notice — does not automatically propagate to copies already delivered to other users before that removal, and these Terms do not otherwise require their removal. This clause does not override applicable law, court orders, or a separately applicable infringement notice concerning a recipient copy.

You represent and warrant that:

  • You own or have the right to upload and use Your Content
  • Your Content does not infringe the intellectual property rights of any third party
  • Your Content does not violate any applicable law or these Terms

The bare list of ingredients in a recipe is generally not protected by copyright, but the creative expression surrounding a recipe — instructions written in your own words, personal anecdotes, original photos — can be. You are responsible for ensuring that any content you upload or export respects applicable copyright law.

Kitchenry is a personal recipe management tool. Digitising a recipe from a cookbook for your own private use is generally considered fair use. Distributing copyrighted recipes to others is your responsibility.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is defamatory, obscene, or infringes third-party rights
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service
  • Interfere with the security or integrity of the Service
  • Create accounts for bots, automated scripts, or non-human users without our written consent
  • Impersonate another person or entity

5. Subscriptions and Payments

Kitchenry offers free and paid subscription tiers. Paid subscriptions are billed monthly via our payment processor, Stripe, on the web, or through the Apple App Store or Google Play for purchases made in our mobile apps. You authorise the applicable billing provider to charge your payment method at the start of each billing period.

Subscriptions automatically renew until cancelled. You may cancel at any time through your account settings or your device's app store. Cancellation takes effect at the end of the current billing period — you keep access through the end of the period you've already paid for. Purchases made through an app store are also subject to that store's billing and refund policies.

Refunds: we offer a 14-day money-back guarantee on your first-time subscription purchase, for any plan. Contact support@kitchenry.app (or use Settings → Subscription → Request refund in the app) within 14 days of your first charge for a full refund. Renewal charges are non-refundable — cancel before your renewal date instead. We reserve the right to review a refund request for signs of abuse (for example, extensive use of paid features before requesting a refund) and to decline it in clear cases of misuse; this is a manual review, not an automatic denial.

EU/UK consumers — right of withdrawal: if you are in the EU/UK, you have a statutory right to withdraw from your subscription contract within 14 days of entering into it, without giving any reason. This right survives your first use of the Service (per CJEU case law, C-234/25, 9 Jul 2026) — it is not limited to before you first access it. Because you expressly requested that we start the Service immediately and acknowledged that doing so may affect your withdrawal right, Directive 2011/83/EU art. 14(3) would ordinarily let us charge you a proportionate amount for use before withdrawal — in practice this does not apply to you, because Kitchenry's 14-day money-back guarantee above is more generous and applies instead, with no deduction for use. To withdraw, use Settings → Subscription → Request refund in the app, or email support@kitchenry.app. You may also use the model withdrawal form below (Directive 2011/83/EU, Annex I(B)):

We reserve the right to change subscription prices. We will give you at least 30 days' notice before any price increase takes effect.

6. AI Features

Kitchenry offers AI-powered features including recipe import and parsing, recipe generation, nutritional analysis, and conversational assistance. Availability and usage limits depend on your subscription plan. These features are powered by third-party AI providers. AI-generated content is provided "as is" and may contain errors. Always verify AI-generated nutritional or dietary information independently, especially if you have allergies, intolerances, or medical conditions.

We reserve the right to adjust AI feature availability, usage limits, and pricing.

7. Intellectual Property

The Service, including its software, design, trademarks, and brand assets, is owned by Kitchenry and protected by intellectual property law. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Nutritional information provided by the Service is for informational purposes only and does not constitute medical or dietary advice. Consult a qualified professional before making significant dietary changes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KITCHENRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

10. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or cause harm to other users or the Service. We will provide reasonable notice before suspension except in cases of severe abuse or legal obligation.

You may delete your account at any time from within the app. Upon deletion, your account profile and personal data under our control will be permanently removed or de-identified within 30 days, subject to records we must retain for legal claims or compliance and the share-record handling described in the Privacy Policy. A recipe copy another user already accepted remains in that user's library as their independent copy.

11. Service Continuity

If we discontinue the Service, we will provide at least 90 days' notice and a data export tool so you can download all your recipes and content before the Service closes.

12. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or in-app notification and update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
